The institution of conditional release in practice
Abstract:
This publication summarises the main findings of a research project focusing on conditional release from prison, specifically from the perspective of probation officers' practical application of the law up to the point at which the court decides on an application for conditional release. It pays particular attention to probation officers' activities in providing professional guidance and support to convicts in preparing for their transition from prison to society, as well as their role in preparing the basis for the court's decision on conditional release. This involves providing a professional assessment of the prisoner's readiness for release, resulting in the Probation and Mediation Service's opinion on the application for conditional release. The publication presents the results of an analysis of these opinions. It also presents findings from an expert survey focusing on probation officers' cooperation with other entities in preparing prisoners for conditional release, such as the prison service, courts, public prosecutors, social workers and non-profit organisations active in the prison system. Attention is also paid to the results of an analysis of court decisions on conditional release, as well as findings from an analysis of data on conditionally released individuals, including data on the remainder of their sentences, conditional release and reoffending. The publication contains proposals for improving current practice in this area.
